It is argued that the use of Sushant Singh Rajput's name/image/caricature/lifestyle without the consent of the legal heir amounts to a violation of his personality right and copyright.
Sushant Singh Rajput’s father has moved the Delhi High Court to deal with movies and other material depicting personal life, name, photography, cartoon, lifestyle, biopic similarity or story (Krishna Kishore Singh vs Sarla A Saraogi).
The court summons nominated by Krishna Kishore Singh (Plaintiff) was issued by the same Judge Bench of Justice Manoj Kumar Ohri.
It is the Complainant's complaint that many people take his son's death "as an opportunity to gain fame by creating various opinions / stories", and to lose his reputation and that of his family.
After reading about movies based on the late actor, such as "Nyay: The Justice", "Suicide or Suicide: The Lost Star", "Shashank", the Plaintiff holds that various games, movies, web series, books, interviews or other important publications may be harmful the dignity of Sushant Singh Rajput and his family.
None of the filmmakers approached the Plaintiff for his permission or consent, it is alleged.
According to the Plaintiff, any publication, production, or disclosure of Sushant Singh Rajput's private life is a clear and deliberate violation of the right to privacy which may be obtained without the consent of his or her legal heir.
It was also requested that the "human right of honor" be granted in proportion to the copyright.
"..the late actor, Shs. Sushant Singh Rajput was a celebrity and has become a name, so it is time for the courts of our country to recognize the right of celebrity in terms of copyright from celebrities. / photo / caricature / way of life without his consent is like a violation of the copyright and the patent given to his son only, "said the suit.
It was also alleged that the plans were "designed to undermine" Sushant Singh Rajput's image and to "disrupt" the CBI's investigation into his death.
As a prayer, the Plaintiff not only sought to prevent the above-mentioned filmmakers in relation to the name, caricature etc of the deceased actor but also to other unknown persons.
The plaintiff demanded Rs 2, 00,02,200 as compensation from those who made the movies for the loss of dignity, trauma and abuse.
Senior Advocate Vikas Singh appeared on the Complaint. The case was referred to Advocates Varun Singh, Akshay Dev, Abhijeet Pandey, Samruddhi Bendbhar of SKV Law Offices.
