The court refused entertain the case on conversion.
The Supreme Court on Friday ruled that people are free to choose their own religion, even as it lashed out at a “very, very harmful kind” of “public interest” claim that there is a mass conversion of people by hook or by crook across the country.
Instead, a bench headed by Justice Rohinton F. Nariman said people have a constitutional right to practice, propagate and profess religion.
“Why should a person over 18 not choose his or her religion? What kind of writing request is this? We will charge you a huge fine ... Withdraw or oppose it and we will jeopardize the results, ”Judge Nariman asked Ashwini's lawyer Kumar Upadhyay.
Justice Nariman reminded Mr Upadhyay of the fundamental right under Article 25 of the Constitution to freely profess, practice and propagate religion, subject to social planning, ethics and health. "Why do you think there is a word for 'distribution'? '" Judge Nariman asked the appellant.
The religious conversion was done using the "carrot and stick", Mr. Uapdhyay had filed his application.
Justice Nariman said everyone is the final judge in choosing a religion or who should be his or her partner in life. Courts cannot interfere in judgment of a person's choice of religion or life partner.
Religious religion is part of the fundamental right to privacy.
Justice Nariman reminded Mr Upadhyay of a decision by the Constitutional Bench that allowed the violation of the right to privacy, equated with the rights to health, dignity and freedom.
Mr Upadhyay's application was rejected. His requests to go to the Law Commission or the High Court in this case were not explicitly approved by the Bench.
The petition stated that the court should direct the State and the United States to regulate witchcraft, superstition and religious conversion by intimidation, intimidation or bribery.
"There is not a single region that is free of magic, superstition and religious perversion ... Weekly incidents are reported across the country where threats are made through threats, intimidation, lure of gifts and financial benefits," the petition said.
In addition, the petition stated that the Institutions and States are obligated under Article 46 to protect the SC / ST community from social injustice and other forms of exploitation.
