Supreme Court of India questions Central Government over functioning of Colonial Sedition Law after 75 years of Independence. SC also asks the government to consider it to repeal as soon as possible. The 75 years old Sedition Law is termed as "Colonial Law used against the freedom fighters of India" the concerned PIL is filed by Mysuru based Major General SG Vombatkere challenged the Constitutional validity of the Section 124A (Sedition) of the IPC (Indian Penal Code) over the maximum imprisonment of life.
Supreme Court of India, while analyzing the matter, a bench led by CJI N.V. Ramana pointed that it is a Colonial Law that used to suppress the view of Tilak and several other revolutionaries who spoke against Britishers and still it needs to be functional after 75 years of Independence. CJI told Attorney General KK Venugopal.
CJI N.V. Ramana further analyzed the Sedition Law and the need to repeal it. It depicts the discriminatory nature of the Government and the Law towards its people as it is not immune to misuse the power by police over those who speak against it the government. CJI stated that it is like you give a saw to a carpenter, and he cuts down an entire forest.
CJI N.V. Ramana, by referencing towards repealing of several stale laws like Triple Talaq and several others, said I don't know why you are not concentrating on this law. Attorney General KK Venugopal stressed that instead of abrogating the whole provision, there should be some parameters over other provisions.
Solicitor General Tushar Mehta said that once the Centre files its counter reply against the plea filed by Major General SG Vombatkere, then it would become more accessible for the court to tackle the issue collectively.
Therefore, the government and court must collectively begin their journey towards thinking about the Sedition provision of IPC. The Government and Court must resolve this issue through talks in a suitable environment and must go for a neural or way that suits most of the country.
