Allotment of Public utility land to Adani group power project canceled by Rajasthan high court

JODHPUR: In a setback to the solar power projects of Adani Renewable Energy Park Rajasthan Limited (AREPRL), the High Court on Tuesday ordered the cancellation of allotment of 1,452 bighas of public utility land to the Adani Group-owned company near Pokhran in Jaisalmer.

AREPRL was allotted 6,115 bighas of land in 2018 to set up a power plant at Nedan village near Pokhran in Jaisalmer district.

A division bench of the Rajasthan High Court, comprising Justice Sangeet Lodha and Justice Rameshwar Vyas, directed the state government to conduct a survey of land parcels allotted to AREPRL and Essel Surya Urja Company of Rajasthan LD (ESUCRL) in three villages - Naden, Ugras, and Nagnechinagar also instructed.

It also ordered the cancellation of allotment of these lands, if any part of it is found to have been allotted to public utilities.

The court gave these directions on a petition filed by Barkat Khan and 23 others objecting to the allotment of public utility land by the state government to solar power companies.

The court further said that the allotment of land adjacent to the land of the petitioners, other Khatedar tenants, and public utilities would also be reviewed by the state government.

This will be done to ensure that their rights are not violated due to the allotment of land to ESUCRL and AREPRL.

The court ordered that the land for the road to reach the land of the khaddar tenants and the Dhani of the residents of the village shall be specially segregated and recorded in the revenue record for the said purpose.

Along with this, the Court also ordered that all the work in accordance with this order will be completed within six weeks from the date of receipt of a certified copy of this order by the State Government.
