Bombay HC Rejected Petition Seeking Permission for Namaz in Mosque With Full Capacity

The Bombay High Court on Wednesday denied the permission to the Juma Masjid Trust, which sought to allow devotees to offer namaz (prayers) five times a day with full capacity while 50 people are allowed at present time in its mosque in south Mumbai during the ongoing holy month of Ramadan.

The High Court observed that the right to follow religious practices is important, the public order and safety of citizens during the Covid-19 surge is of “paramount importance” for now. Hearing a petition registered under the Bombay public trust and waqf Act, was done so that social distinctions and standard operating procedures could be followed.The trust said that the mosque can accommodate 7000 people at a time, but pleaded said that only 50 people are allowed to offer Namaz or prayers during the holy months because of the health crisis.


According to the report, the HC said, following the religious practices, the public order, and The safety of the citizens in this COVID-19 Pandemic is important for us. Article 25 of the constitution of India stated in the order of the court however gives equal rights to all persons to practice and propagate the freedom of conscience equally and the religion freely. Public order, on the other hand, is subjected to morality and health.


Opposing the petition, the state Counsel Jyoti Chavan said,'' we cannot make Ramzan an exception and in any religion, especially in these 15 days we cannot take a risk at this level and Cooperate All Citizens.
